New Name....Same Game....Joe & Josh Chisenhall, Owner/Operators of Atlas Transmission, have left many Tennessee & Southern Kentucky residents with more transmission trouble then the vehicle owners started with. BBB files contain a pattern of complaints alleging the company quotes one price when the customer leaves the vehicle for a diagnostic test; however, when the customer returns to retrieve the vehicle the company's price increases substantially. In addition, the Chisenhalls will not release the vehicle without a cash payment causing some consumers to incur storage fees. Other complaints allege poor customer service, unauthorized repairs and failure to make timely repairs. The Chisenhalls have moved their store location and changed their name several times trying to hide from their past; however, they continue to perform at each new location using the same unethical business practices as before. Fort Campbell has placed the Chisenhall's on their Military Off-Limits list which restricts all military personnel from doing business with the Chisenhalls. Want free electricity? Interested in doubling your gas mileage? That's what Dennis Lee, President of International Tesla Electric Company, is trying to sell to the public. Since 1999, the Attorney Generals of 7 States have taken action against Mr. Lee associated with three companies purporting to sell a free electricity device. Lee was arrested in 2001 in Kentucky on counts of failing to register a business opportunity, failing to include the business opportunity registration number in advertisements and for making false claims. Other states have barred the defendant from conducting sales presentations on free electricity devices and other related technologies. Lee faced a contempt order in another state for violating a settlement that prohibited him from selling the advertised free electricity device. In October 1999, the Attorney General of the State of Tennessee obtained a temporary restraining order against Dennis Lee and other seminar organizers pending a motion to stop Dennis Lee from doing business in Tennessee. Most recently, Lee is touting a fuel saving's device claiming it will create a 50% increase in gas mileage. In May 2008, BBB contacted the company to request substantiation of the fuel savings claims. The company has failed to respond and the advertising challenge has been closed as unanswered and unsubstantiated.

Complaints allege the company charges consumer credit cards for merchandise ordered via their website; however, the company fails to deliver the products. In addition, complaints allege consumers are unable to reach a customer service representative to discuss their concerns as the company's voicemail is usually full. On May 14th & May 27th 2008 BBB attempted to reach the company via phone in order to discuss the volume and pattern of complaint received. BBB was able to leave a message on May 14th; however, the voice mail was full when we attempted to reach the company on May 27th. To date, the company has not returned the BBB's voice message, nor have they resolved most complaints on file. We believe this company needs to take some customer service 'mending' classes of its own.

Complaints filed with BBB allege consumers paid in advance for landscaping and lawn maintenance services for which Hector Rosa failed to complete as contracted. Customers were asked to leave advance payments in mail boxes or under door mats. Attempts by consumers to contact Mr. Rosa via phone have gone unanswered. In April 2008, BBB became aware of Mr. Rosa's current name style of Phoenix Turf Company. BBB continues to receive similar complaints as were filed against Greenscapes of Nashville.

Caller ID Spoofing: Caller ID allows you to identify a caller before you answer your telephone, but con-artists and unethical telephone solicitors have found a way to mask their identity using a practice called Caller ID Spoofing. This practice is a way for disreputable parties to deliberately falsify the telephone number relayed as the Caller ID number to disguise the identity and originator of the call. The Federal Communications Commission Rules prohibit telemarketers from blocking Caller ID information, and requires callers to pass accurate caller ID numbers. This practice is a violation of the Truth in Caller ID Act of 2007.
